Terms of service

What you are agreeing to when you book, who is responsible for what, and how we handle it when something goes wrong.

Who you are dealing with

Yalator is operated by Elevate Tourism L.L.C, licensed in Dubai, United Arab Emirates under trade licence number 916444 and registered at Elevate Tourism Hub, Office No. 10, Al Khayat Avenue, Al Quoz 1, Dubai, United Arab Emirates. These terms apply when you book anything through this site or through our iPhone or Android apps.

Two different things are sold here, and the difference matters:

  • Experiences we run ourselves, where Elevate is the operator and is directly responsible for delivering what you booked.
  • Experiences run by third-party operators, where we take the booking and the payment, and the operator delivers the experience.

In both cases your booking is with us and we are who you talk to when something goes wrong. We do not send you off to argue with an operator you have never met — dealing with them is our job.

Making a booking

Choosing an experience and entering your card does not by itself create a confirmed booking. Your card is authorised — the amount is held, not taken — and the booking goes to the operator to confirm.

The contract is formed when we send you a confirmation email. Until then you have a request and a hold on your card, and if the booking cannot be accepted the hold is released and you are charged nothing.

You must be 18 or over to make a booking, and you are responsible for the accuracy of what you tell us — particularly the ages of travellers, where these affect the price or whether somebody may take part at all.

Prices and payment

Prices are shown in the currency stated and include UAE VAT at 5%. The total at checkout is what you pay: there is no booking fee and no card surcharge.

We take payment when the booking is confirmed, not before. If a price is displayed incorrectly through an obvious error, we will tell you before taking any money and you may cancel without charge — we will not quietly charge you a different amount from the one you agreed to.

Changes and cancellations

Cancellation terms are set per experience and are shown before you book, at checkout and on your confirmation. They are covered in full in the cancellation policy, which forms part of these terms.

If we or the operator cancel, you receive a full refund regardless of those terms. Where an operator must change a departure time or a detail of the itinerary, we will tell you as soon as we know, and if the change is material you may cancel for a full refund instead of accepting it.

On the day

Arrive at the stated meeting point at the stated time. Operators run to a schedule and cannot always wait; a missed departure through late arrival is treated as a no-show.

Operators may refuse participation on genuine safety grounds — for example where somebody is intoxicated, where a stated health or age restriction is not met, or where safety instructions are ignored. In those cases the booking is treated as used.

Where an experience carries physical demands or restrictions, they are stated on its page. Please read them, and ask us first if you are unsure whether something is suitable.

Where our responsibility sits

We are responsible for taking your booking correctly, for the payment being right, and for dealing with the operator on your behalf. If we get those wrong, that is ours to fix.

We are not responsible for things genuinely outside anyone’s control — weather, road closures, government restrictions — beyond refunding you when they stop an experience running.

Nothing here limits liability where the law does not allow it to be limited, including for death or personal injury caused by negligence.

Insurance. Each operator is responsible for the experience they run, including holding the cover their own licence and activity require. We are not an insurer, and a booking with us is not insurance. We strongly recommend your own travel insurance — for medical costs, for cancelling for reasons personal to you, and for your belongings — none of which a booking covers.

The law that applies

These terms, and any dispute about them or about a booking made under them, are governed by the laws of the United Arab Emirates, and the courts of Dubai have jurisdiction.

This does not take away any right the law gives you, and nothing here allows us to. If a part of these terms turns out to be unenforceable, the rest still applies.

Complaints

Tell us as early as you can, ideally while you are still at the experience — most problems are fixable on the spot and very few are fixable a week later.

Contact us with your booking reference and what happened. We will look into it with the operator and come back to you. We would rather hear about a problem than read about it somewhere else.
